The terms on which businesses and professionals use Agent Flow Bind.
Version: 2026-10-05-preliminare
These terms are a translation of the Italian terms of service, which prevail (clause 16.4).
1.1. The Agent Flow Bind service (the "Service") is provided by Agent Flow Bind, email contact@agentflowbind.com ("we" or the "Provider"). Full company details will be published on this page.
1.2. These terms govern the relationship between the Provider and the business, professional or organisation that creates an account or uses the Service (the "Customer"). Whoever accepts these terms on the Customer's behalf declares that they have the authority to do so.
1.3. The Service is intended exclusively for businesses and professionals acting in the course of their trade or profession. It is not offered to consumers; the rules of the Italian Consumer Code do not apply.
1.4. The contract is made up of: these terms, the price list published at agentflowbind.com/pricing at the time of purchase, the privacy notice and, when the Customer processes personal data with the Service, the data processing agreement (DPA) referred to in clause 10.
3.1. The Service includes ready-made, customisable artificial-intelligence agents, reachable from: the web console
(console.agentflowbind.com), the public API (api.agentflowbind.com), Published Apps, the phone and WhatsApp channels,
the Windows desktop app and the local runner afb-runner.
3.2. AI models. Agents use models from third-party providers. The Customer chooses which models each agent may
use, within its workspace's "Allowed data regions" setting (eu, eu_us or any); on the free plan the models are
set by the Provider. The list of providers and their rules is published on the Your data page.
3.3. Local execution. With the local runner or the desktop app, agents run on the Customer's computer with the Customer's own model-provider key; the Customer receives a signed agent definition valid for 90 days, plus a 14-day grace period, renewed while the contract is active. The runner reports only count data to us, unless the Customer turns that off too.
3.4. Evolution. The Service is under continuous development: we may add, change or withdraw features and agents. If we withdraw a feature essential to a paid plan, we give 30 days' notice. Withdrawn agents may keep working for those who already use them, without new ones being created.
4.1. The Service is offered as a beta. Some features are marked "beta" or "preview" (for example the SDK). During the beta the Service may contain errors, change without notice and be temporarily unavailable.
4.2. During the beta the number of new organisations is capped; once the cap is reached, sign-up closes and you can leave your email on the waiting list. People invited by a Customer do not take a place.
5.1. Signing up requires a name, a work email, a password of at least 12 characters and the organisation name, and accepting these terms. The Customer undertakes to provide true and up-to-date data. Until the email is verified (link valid 24 hours) a workspace can start at most 3 runs.
5.2. The Customer can invite colleagues and assign roles (owner, admin, member, viewer, consultant; in projects admin, editor, runner, viewer). Only the workspace owner can buy plans and credits and change the data-region setting. The number of seats depends on the plan.
5.3. Credentials and API keys. The Customer keeps passwords and API keys safe and is responsible for their use. An API key is shown only once: we keep only a fingerprint of it and cannot recover it; a lost key must be revoked and replaced. The Customer tells us at once at contact@agentflowbind.com if it suspects unauthorised access.
5.4. Technical limits. Each plan has limits on API requests per minute, Published Apps, seats and storage space, shown in the price list.
6.1. Credits. The agents' work is paid for in credits. A run consumes credits for the work actually done, measured as follows:
Before a run the Service shows an estimate; at the end the trace shows the actual cost of each step.
6.2. Free trial. At sign-up the new workspace receives, once, 500 trial credits, with no credit card. Invited people do not receive trial credits.
6.3. Subscription plans. Paid plans are monthly subscriptions with an allocation of credits per period; prices, included credits and limits are those in the price list at the time of purchase. Prices exclude VAT.
6.4. Credit packs. A workspace with an active paid plan can buy additional credit packs; packs cannot be bought on the free trial alone. When the plan's credits run out, runs draw on purchased credits. Credits bought in a pack expire 12 months after purchase.
6.5. Payment. Payments are made through Stripe Checkout; card data is handled by Stripe and does not pass through our systems. Subscription invoices are issued through Stripe and can be viewed in the console.
6.6. Spend controls. The Customer can set a monthly workspace spend cap, a daily cap for each Published App and a maximum budget per run, and receives alerts at 50%, 80% and 100% of the cap. When a cap is reached, new runs stop. If the balance is not enough, a run does not start.
6.7. Credits of failed runs. If a run stops because of a platform error or a restart of our systems, the reserved credits return to the balance in full. A run that ends, even with a negative or "to review" outcome, consumes the credits for the work done.
6.8. Refunds. Refund requests are sent to contact@agentflowbind.com; the refund policy will be published on this page.
6.9. Price changes. We may change prices and plans with at least 30 days' notice by email; the change applies from the next billing period and the Customer may cancel before it takes effect.
6.10. Cancelling the subscription. The Customer can cancel the subscription by writing to contact@agentflowbind.com; cancellation takes effect at the end of the current billing period.
7.1. The Customer uses the Service in compliance with the law and these terms, and is responsible for it also for its own users and the users of its Published Apps.
7.2. In particular, it is forbidden to:
7.3. We may suspend access, without notice where needed to prevent harm, if the Customer breaches this clause, if a use puts the security of the Service at risk or if an authority asks us to.
8.1. Ownership. Customer Content remains the Customer's. The Customer grants us the right to use it only to provide the Service: to store it, process it, and send it to model providers and to the destinations the Customer chooses.
8.2. No training. We do not use Customer Content to train artificial-intelligence models. Model providers process it under their own rules, published on the Your data page.
8.3. Output. Outputs are generated by artificial-intelligence models and may be inaccurate, incomplete or not fit for purpose. The Customer must check them before using them or making decisions based on them. Outputs are not legal, tax, accounting or financial advice. To the extent permitted by law, Outputs belong to the Customer.
8.4. Human oversight. The Service provides human-oversight tools:
8.5. Phone agents. At the start of every call the agent states that the call may be recorded and that an artificial-intelligence assistant is answering, in the language of the country set for the workspace. The Customer remains responsible for checking that this message is sufficient under the law that applies to its calls, for obtaining the necessary consents and, for outbound calls, for complying with telemarketing rules and the Italian do-not-call register. The Service does not perform these checks. Outbound calls are limited by daily number and by destination.
8.6. Published Apps. The Customer is responsible for its Published Apps towards its own users: for the information it gives them, the privacy notice, the terms of use and the content it makes available.
8.7. Connected third-party services. When the Customer connects its own third-party accounts (Twilio, Exotel or SIP-trunk numbers, WhatsApp numbers on Meta or Twilio, storage, databases, SFTP servers, webhooks), those providers' terms also apply. We use the Customer's credentials only for the features the Customer turns on; we keep them encrypted and never return them through the API.
9.1. The Service, the software, the prebuilt agents, their definitions, the document templates, the brand and the documentation belong to the Provider or its licensors. The Customer receives a non-exclusive, non-transferable right of use limited to the term of the contract.
9.2. Suggestions the Customer sends us about the Service may be used by us freely to improve it.
10.1. For personal data contained in Customer Content (for example data in invoices and contracts, the calls of the people the Customer deals with, WhatsApp conversations, data of Published App users) the Customer is the controller and the Provider is the processor under Art. 28 GDPR.
10.2. The Provider processes this data only to provide the Service and on the Customer's documented instructions, which include the agents' configuration, the choice of models and the "Allowed data regions" setting.
10.3. DPA. A data processing agreement under Art. 28 GDPR, with the list of sub-processors, is available on request at contact@agentflowbind.com and prevails over these terms as regards the processing of personal data.
10.4. The Customer gives general authorisation to the use of the sub-processors listed in the DPA and in the privacy notice (hosting, model providers and their intermediary, email, payments, voice and telephony). We give at least 30 days' advance notice of the addition or replacement of a sub-processor; the Customer may object on reasonable grounds.
10.5. By choosing the eu_us or any setting, or models hosted outside the EU, the Customer instructs the Provider
to transfer the data of individual requests to the countries where those models run, including outside the EEA. The
Customer assesses whether the transfer is compatible with its own obligations.
10.6. The Customer warrants that it has a legal basis for the data it puts into the Service and that it has informed the data subjects, including the people who speak with Phone and WhatsApp agents and the users of Published Apps.
10.7. For data we process as controller (account, billing, site, demo) the privacy notice applies.
11.1. We do our best to keep the Service available and working correctly, but during the beta we offer no guaranteed service level (SLA). The Service may be interrupted for maintenance, updates, faults or unavailability of third-party providers (for example model or telephony providers); in these cases new runs may be temporarily paused.
11.2. The Customer is responsible for keeping copies of the Customer Content and Outputs it needs, using the Service's export features.
11.3. Support is provided by email at contact@agentflowbind.com, in Italian, German or English, on working days.
12.1. The Service is provided "as is" and "as available". To the extent permitted by law, we do not warrant that the Service is error-free or uninterrupted, nor that Outputs are accurate or fit for a particular purpose.
12.2. To the extent permitted by Art. 1229 of the Italian Civil Code, the Provider is not liable for indirect or consequential damage, loss of profit, loss of data that was not exported, or damage arising from Outputs used without the review required by clause 8, from actions pre-approved by the Customer, or from third-party services connected by the Customer.
12.3. In any event the Provider's total liability to the Customer is limited to the amount paid by the Customer in the 12 months before the event.
12.4. The limitations in this clause do not apply in case of wilful misconduct or gross negligence, nor to obligations that the law does not allow to be limited.
12.5. The Customer indemnifies the Provider against third-party claims arising from Customer Content, from breach of clause 7 or from the lack of a legal basis for data the Customer put into the Service.
13.1. The contract lasts as long as the Customer keeps an account. Subscriptions renew month by month until cancelled (clause 6.10).
13.2. The Customer can close the account at any time by writing to contact@agentflowbind.com.
13.3. We may terminate with 30 days' notice by email, or with immediate effect in case of serious breach of these terms, non-payment not remedied within 15 days of a reminder, or unlawful use of the Service.
13.4. On closure, the Customer has 30 days to export its Customer Content and Outputs; after that we delete them, except data we must keep by law and except the copies in backups, which are deleted within 7 days. Unused credits lapse on closure.
14.1. We may change these terms for legal, technical or commercial reasons. Changes are notified by email or in the console at least 30 days in advance, except those required by law or concerning new features. If the Customer does not accept them, it may terminate before they take effect; by continuing to use the Service after that date it accepts them.
14.2. At sign-up the Customer accepts these terms explicitly; the Service records the accepted version and the date of acceptance on the account.
15.1. These terms are governed by Italian law.
15.2. Any dispute is referred to the court having jurisdiction under Italian law.
16.1. If a clause is invalid, the others remain in effect.
16.2. The Customer may not assign the contract without our written consent.
16.3. Notices to the Provider are sent to contact@agentflowbind.com; notices to the Customer go to the workspace owner's email.
16.4. In case of differences between the Italian and the English version, the Italian version prevails.
Under Arts. 1341 and 1342 of the Italian Civil Code, the Customer declares that it specifically approves the following clauses: 3.4 (evolution of the Service); 4.1 (beta); 6.4 (credit expiry); 6.8 (refunds); 6.9 (price changes); 7.3 (suspension); 11.1 (no SLA); 12 (warranties and limitations of liability); 13.3 (termination by the Provider); 13.4 (deletion of data on closure); 14 (changes to the terms); 15.2 (jurisdiction).
